Terms of Service

These Terms of Service ("Terms") govern your access to and use of reliabledispatchco.site (the "Site") and the Freight Rate-Per-Mile (RPM) & Load Profitability Calculator and any related content (together, the "Service"), operated by Reliable Dispatch Co. ("we", "us", "our"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. The Service is intended for trucking, dispatch and logistics professionals.

2. The Service

The Service provides a browser-based calculator that estimates rate per mile, fuel cost, dispatcher fees, cost per mile, net profit and break-even payout from figures you enter, along with informational articles about freight economics. All calculations run locally in your browser. We may change, suspend or discontinue any part of the Service at any time without notice.

3. No professional advice

The Service is provided for general informational and planning purposes only. It does not constitute financial, accounting, tax, legal, investment, or business advice, and it is not a substitute for professional judgement or for a signed rate confirmation from a broker or shipper. Freight rates, fuel prices, regulations and market conditions change constantly. You are solely responsible for verifying all figures and for every booking, pricing, routing and dispatch decision you make. Always confirm terms directly with the broker or shipper before dispatching a load.

4. Accuracy and estimates

Outputs are estimates based only on the inputs you provide and on simplified formulas. They may exclude tolls, permits, IFTA, detention, lumper fees, accessorials, driver pay splits, maintenance reserves, insurance deductibles, factoring costs and other real-world expenses unless you incorporate them into your inputs. We do not warrant that any output is accurate, complete or suitable for your circumstances.

The Site, its design, text, graphics, and the calculator code are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own internal business or personal use. All other rights are reserved. Trademarks and product names such as DAT, Truckstop and 123Loadboard belong to their respective owners and are referenced for identification only; we are not affiliated with, endorsed by, or sponsored by them.

The Service is supported by advertising, including Google AdSense. Ads and sponsored content are provided by third parties and their presence does not imply our endorsement. The Site may contain links to third-party websites and resources. We are not responsible for the availability, content, products, services or practices of any third party. Your dealings with advertisers or linked sites are solely between you and that third party. See our Privacy Policy for how advertising cookies are used.

8. User submissions

If you send us feedback, suggestions or other materials, you grant us a perpetual, irrevocable, royalty-free licence to use them without restriction or compensation to you. We are under no obligation to keep submissions confidential.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL RELIABLE DISPATCH CO., ITS OWNERS, EMPLOYEES OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE OR RELIANCE ON ANY OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED USD 100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless Reliable Dispatch Co. from any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to these Terms

We may revise these Terms at any time by posting an updated version with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law and venue

These Terms are governed by the laws of the State of New York, USA, and applicable United States federal law, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York, USA, and you consent to the personal jurisdiction of those courts, subject to any mandatory consumer-protection rights you may have in your place of residence.

14. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the Service.
